Justice Khanna’s Appointments as the next CJI
The Union Government has now confirmed Justice Khanna’s appointment as the next Chief Justice of India. He will take office on November 11, 2024, succeeding CJI DY Chandrachud, and will serve for about seven months until May 13, 2025.
Education
Justice Khanna completed his schooling in 1977 at Modern School, a well-regarded institution in Delhi.
He then attended St. Stephen’s College, Delhi, where he graduated in 1980. St. Stephen’s, known for nurturing influential leaders, significantly contributed to the development of his critical thinking.
Driven by a passion for law, he pursued legal studies at the Campus Law Centre, University of Delhi, where he honed his legal expertise.
Justice Khanna’s Legal Career
Justice Sanjiv Khanna began his legal career in 1983 as a lawyer in Delhi, practising first in the district courts at Tis Hazari before moving to the Delhi High Court and other tribunals. In 2005, he was appointed as an additional judge of the Delhi High Court, becoming a permanent judge in 2006.
During his time at the Delhi High Court, he also held key roles at the Delhi Judicial Academy and the Delhi International Arbitration Centre. On January 18, 2019, he was promoted to the Supreme Court, making him one of the few judges to reach the top court without first serving as a Chief Justice of a High Court. Justice Khanna is the nephew of Justice Hans Raj Khanna, known for his famous dissent in the ADM Jabalpur case and Keshavanand Bharti Case.
Notable Judgements by Justice Khanna
Justice Khanna is known for several notable rulings. In 2019, he led a ruling that made the Chief Justice’s office subject to the Right to Information (RTI) Act. He also emphasized regulating hate speech in a significant judgment.
In 2021, he dissented in a case about the Central Vista project, arguing that proper procedures had not been followed. He has ruled on important cases, including the politically sensitive Delhi liquor policy case involving AAP leaders. His bench refused bail to Manish Sisodia but expedited his trial and allowed bail for Sanjay Singh after facing tough questions from the court.
In May 2023, Justice Khanna granted interim bail to then-Delhi Chief Minister Arvind Kejriwal for election campaigning and referred the broader issue of arrest grounds under the Prevention of Money Laundering Act (PMLA) to a larger bench. His bench also handled cases related to voting machines (EVMs) and VVPAT verification, and he was part of important decisions on Article 370 and the Electoral Bonds scheme. In the Electoral Bonds case, he gave a separate opinion pointing out how the scheme violated constitutional rights.
